By accessing or using the GemmoPrice platform (“the Service”), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service. GemmoPrice is a division of GEMCO di Paolo Cerruti, a sole proprietorship registered in Italy, with registered office at Via Al Ponte Reale 2/7, 16124 Genova, Italy.

2. Nature of the Service

GemmoPrice is a professional market intelligence platform that aggregates and presents publicly available auction results from specialized jewellery sales at leading international auction houses. The Service is designed exclusively as a research and reference tool for trained professionals in the gem and jewellery trade.

GemmoPrice is not a valuation service, a price list, or a pricing authority. The data presented on this platform reflects historical auction results and does not constitute a current market value, a formal appraisal, or any form of investment advice.

3. Disclaimer on Data Accuracy and Completeness

All records presented on GemmoPrice are sourced from publicly available information declared by the respective auction houses. GemmoPrice does not independently verify, audit, or guarantee the accuracy, completeness, or currency of this data.

Auction houses may at any time modify, remove, or make inaccessible the original lot pages and associated content. GemmoPrice accepts no responsibility for the unavailability, removal, or alteration of third-party content referenced or linked within the platform.

Users who identify errors or inaccuracies in the data are encouraged to report them to info@gemmoprice.com. GemmoPrice will endeavour to correct confirmed errors in a timely manner but accepts no liability for any commercial, financial, or professional consequences arising from reliance on inaccurate data.

4. Limitation of Liability for Commercial Decisions

GemmoPrice expressly disclaims all liability for any purchase, sale, appraisal, or commercial decision made by a user in reliance on data presented on the platform.

Auction results are market indicators, not definitive price references. They must be interpreted by qualified professionals in the context of the specific transaction, taking into account factors including but not limited to:

The quality, condition, and unique characteristics of individual stones, which may not be fully captured in photographic or written descriptions
The presence of prestigious jewellery brand associations (e.g. Cartier, Van Cleef & Arpels, Bulgari), which can significantly elevate the hammer price of a gemstone beyond its intrinsic value
The composition of buyers present at a specific sale, including private collectors, trade buyers, and institutional acquirers, whose motivations may drive prices above or below typical market ranges
The provenance, auction house reputation, marketing effort, and timing of the sale
Qualitative differences between stones with identical laboratory grading parameters that are not visible through photography
Currency fluctuations and regional market conditions at the time of the sale

GemmoPrice does not provide buying or selling recommendations under any circumstances.

5. Intellectual Property — Images and Multimedia Content

GemmoPrice does not own the photographs, video content, or any other multimedia material associated with auction lot records. All such content remains the exclusive property of the respective auction houses and resides on their own servers. GemmoPrice provides links or references to this content solely for informational purposes.

GemmoPrice makes no claim over such material and accepts no responsibility for its availability, accuracy, or continued accessibility. Any use of auction house imagery beyond personal professional reference must be authorized directly by the respective rights holder.

6. Exchange Rates

Currency conversions displayed on the platform are calculated using reference rates published by the European Central Bank (ECB) via its official data feed. These rates are updated regularly but may not reflect real-time market rates. GemmoPrice accepts no liability for financial decisions made on the basis of displayed currency conversions.

7. Subscription and Access

Access to full price data on GemmoPrice requires a valid paid subscription. During the free trial period, search and filter functionality is available but hammer prices and sold prices are masked. Subscriptions are fixed-term and do not auto-renew. Subscription fees are non-refundable except where required by applicable law.

GemmoPrice reserves the right to suspend or terminate access to any user who breaches these Terms, misuses the platform, or attempts to systematically extract, copy, or redistribute database content.

8. Prohibited Uses

Users may not:

Reproduce, redistribute, resell, or publish any portion of the GemmoPrice database without prior written consent
Use automated tools, scrapers, bots, or scripts to extract data from the platform
Share account credentials with third parties
Use the Service for any unlawful purpose or in violation of applicable regulations

9. Privacy and Data Protection

GemmoPrice processes personal data in accordance with applicable data protection legislation, including the EU GDPR, UK GDPR, CCPA, and LGPD. Please refer to our Privacy Policy for full details on how we collect, use, and protect your personal information.

10. Modifications to the Service and Terms

GemmoPrice reserves the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. These Terms may be updated periodically. Continued use of the Service following any update constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Court of Genova, Italy.
